Prices for our products are subject to change without notice. Prices for fine jewelry featuring precious metals is subject to market fluctuations and liable to change.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

YOUR RIGHTS

MOBILE MESSAGE SERVICE

The Lizzie Fortunato mobile message service (the “Service”) is operated by Lizzie Fortunato (“Lizzie Fortunato”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Lizzie Fortunato’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Lizzie Fortunato through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Lizzie Fortunato. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18558120302 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Lizzie Fortunato mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

LIZZIE FORTUNATO’S RESALE PROGRAM

Our resale collection provides the ability for customers to purchase pre-owned products from other individuals through our site.

The resale services are provided through our site with the assistance of a third-party resale service provider. Please see our Privacy Policy for more information regarding how your data is shared with our service providers.

How it Works:
Buyers:
– Choose an item from our resale collection. If you would like to buy a resale item, you can add it to your shopping cart and check out (just as you would for a new item).
– Once you purchase an item, the individual seller is provided with a pre-addressed shipping label to ship the item to your shipping address. We will provide you with the tracking number for your order.
– Once you receive the item, we will send you an email to confirm that the item’s condition is the same as advertised in the listing. If you choose “No”, then you will be directed to an online dispute form to provide more information regarding the item’s condition. Our customer support team may reach out to you for more information to resolve the dispute. If you do not confirm the item’s condition within 72 hours of delivery, you forfeit the right to dispute the item’s condition.

Sellers:
– Create an account or log in to your existing Lizzie Fortunato account.
– Choose an item to sell from the past purchases in your order history. Optionally, you may also manually enter the item details if not listed in your order history.
– Input the details about your item to be listed on our website through the online form that we generate. By inputting the details about your item to be listed (“Item Details”), you hereby grant to us and to our resale service provider, and our respective parents, subsidiaries, affiliates, licensee, successors, and assigns, a non-exclusive, transferable, perpetual, irrevocable, worldwide, royalty-free license, with the right to sublicense through multiple tiers, to use, copy, modify, create derivative works based upon, distribute, and publicly display and perform such Item Details in whole or in part in connection with: (a) making the Item Details available on our site as part of the applicable item listing; (b) including the Item Details in email communications to you and the Buyer; (c) using the Item Details to derive or generate insights and analytics on an aggregate and deidentified basis; (d) using the Item Details in connection with promotion and marketing of our or our resale service provider’s products and services or for any other lawful purpose, including within email marketing, newsletters, pitch decks, and other media.
– Once you submit the form, you will receive a confirmation email that your listing has been submitted.
– After review by Lizzie Fortunato] or our resale service provider, if the listing is approved, it will appear in the resale collection in Lizzie Fortunato’s website. If the listing is rejected, we will provide you with the reasons for rejection and may provide you the opportunity to resubmit your listing.
– If a Buyer purchases your item, we will send you an email (and text message, if you opted in to receive text notifications) notifying you of the sale, along with a pre-addressed, pre-paid shipping label to send the item to the Buyer. Then, you are required to ship the item to the buyer using this label. We will send automatic reminders to ship the item after the sale is made. All Sellers are encouraged to ship the product within 3 days.
– Once the item is delivered, the Buyer has 72 hours to confirm the item’s condition. If the Buyer reports that the item’s condition is not in the condition you entered in the listing, we will collect more information from the Buyer regarding the item’s condition and our support team may reach out to you for more information. If our resale service provider’s customer support team determines that the item is not in the condition you entered in the listing, we have the right to not pay the sale proceeds to you.
– After Buyer confirms the condition of the item (or fails to respond within 72 hours of receiving the item), we will automatically generate a digital gift card to the Lizzie Fortunato online store at an amount equal to 100% of the sale proceeds to be sent to you within 24 hours.

Other Resale Terms:
YOU ACKNOWLEDGE THAT, BY PURCHASING AN ITEM FROM OUR RESALE COLLECTION, YOU ARE PURCHASING A USED ITEM FROM AN INDIVIDUAL SELLER AND NOT FROM LIZZIE FORTUNATO. THEREFORE, MERCHANT DISCLAIMS ANY AND ALL WARRANTIES RELATED TO THE ITEMS SOLD THROUGH ITS RESALE COLLECTION, INCLUDING WITH RESPECT TO THE ITEM’S MERCHANTABILITY, CONDITION, FITNESS FOR PARTICULAR PURPOSE, OR ABSENT OF DEFECTS. IF YOU BELIEVE THE CONDITION OF AN ITEM YOU PURCHASED IS NOT CONSISTENT WITH THE RESALE LISTING ON OUR SITE, THEN YOU MAY DISPUTE THE CONDITION AS DESCRIBED ABOVE.

MINORS

The Site is not intended for individuals under the age of 18.

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
